Hi there! There are some cases where CM's version of Military Law doesn't explicitly cover a given scenario. And this is one of them.
CM's ML does state that we can assume that most major US Laws would apply, so Double Jeopardy is implied, but not written.
I mention this because I don't want anyone to read this and take it as the core idea of not being charged for the same crime twice doesn't apply.
    That said,

The logs show that the appeal for contraband was granted on testimony of the CMO.
The logs also show that after the appeal was accepted, a scan on the dosed cadet showed he had been given illicit drugs.
The original appeal was not retroactively overturned, a new charge was brought forward on the basis of additional evidence.
In the real world, a jury would decide if it was sufficient to bring new charges, but that's not something that is currently feasible in CM.

Given how ML is written, it appears that MPs are expected to investigate and make all charges at the time of arrest for an incident, but it's not stated explicitly, and given that the CMP did arrest on new charges based on the medical date from the cadet, it doesn't appear to be intent to grief, and it appears to be a reasonable attempt to follow the spirit of the law.

I will forward this to Forest/Nanu to clarify this point in ML if they determine it necessary, but the logs show the CMP made a reasonable attempt to follow ML in an area where it was unclear.
